New statement of changes to the Immigration rules


A significant statement of changes to the Immigration rules on asylum, EU settlement scheme, Ukraine scheme and on students bringing their dependents has been published on 17th of July 2023.
As per the changes in EU settlement Scheme, people with pre-settled status will automatically have their visa extension prior to the completion of 2years before it expires if they have not obtained settled status. Nobody will lose their immigration status if they do not apply to switch from pre settled status to settled status. The changes in EUSS will come in to effect on 9th August 2023.
Home office extended the application deadline for the Ukraine Extension Scheme for a further six months to 16 May 2024. Ukraine nationals and their family members who obtain permission to enter or stay in the UK for any period in between 18 March 2022 and 16 November 2023 to apply to the Ukraine Extension Scheme and obtain 36 months' permission to stay in the UK. These changes will come in effect on 7th of August 2023
With regards to the student route(dependents and switching), Home Office removes the right for international students to bring dependents unless they are on post graduate courses currently designated as research programmes with effect from 7th of August 2023. As per the new changes international students cannot switch out of the student route in to work routes before their studies have been completed.
Home office also stopped taking grouping decisions under the differentiated asylum system as per the rule change and those individual who are unsuccessful in their asylum will receive the same conditions and the ability to remove failed asylum applicant remains unchanged. Home office paused the differentiation policy in the next package of immigration rules and improves clarity regarding withdrawing asylum claims. These changes already came in force on 17th of July 2023 at 3pm.
